यह Chapter EO/RO के लिए अत्यंत महत्वपूर्ण है। इसमें public street की regular line, underground utilities, Government roads, festival structures, footpaths, corner buildings, setback, building permission, deemed permission, occupancy certificate, apartment complexes, construction display board, hoardings तथा private agencies द्वारा विकसित colonies को Municipality द्वारा takeover करने के नियम आते हैं।
Current-verification note: Official Rajasthan Municipalities Act में Sections 183–199 इसी विषय-वस्तु को cover करते हैं। India Code में भी यही statutory sequence दर्ज है। Act का उपलब्ध official consolidated PDF “Last Updated 5th October 2019” बताता है, जबकि Rajasthan UDH की current official website पर Rajasthan Building Bye Laws–2025 उपलब्ध हैं। इसलिए Building Permission वाले हिस्से में Act + वर्तमान Building Bye-Laws 2025 को अलग-अलग समझना जरूरी है।

3. SECTION 183 — Regular Line of Public Street
Regular Line — नियमित सड़क सीमा रेखा
हर Municipality को public street के एक तरफ, या दोनों तरफ एक line prescribe करनी होगी। इसका उद्देश्य मुख्यतः Public Street को widen करना हो सकता है।
Fresh Regular Line: Municipality आवश्यकता होने पर Existing line को replace करके Fresh Line prescribe कर सकती है। लेकिन यह process बिना notice के नहीं हो सकती।
One-Month Notice: नई regular line prescribe करने से कम-से-कम 1 महीने पहले Municipality को Special Notice देना होगा। Notice street/affected part में लगाया जाएगा; affected land के owners/occupiers को भी दिया जाएगा।
Exam Fact: Regular Line → 1 Month Previous Notice
Objections & Suggestions: Affected persons द्वारा दिए गए written objections और suggestions Municipality को consider करने होंगे।
Regular Line Map: Municipality को Map तैयार करना होगा जिसमें prescribed line, concerned street, enclosed lands दिखाए जाएंगे। यह map और land statement Public Inspection के लिए उपलब्ध होगा।
Regular Line का Legal Effect: Prescribed line Regular Line of Public Street कहलाती है। इसके बाद इस line के भीतर कोई व्यक्ति building construct या reconstruct नहीं कर सकता।
Section 183 — Penalty: यदि कोई व्यक्ति regular line के भीतर construction/reconstruction करता है: Fine ₹2,000 से ₹5,000 तक और Municipality construction रोक सकती है; written notice देकर construction/demolition करा सकती है।
Appeal: Section 183(4) के order से aggrieved person 30 days के भीतर Collector को appeal कर सकता है। Collector का appellate order Final है और Court में challenge नहीं किया जा सकता।
4. SECTION 184 — Underground Utilities
State Government rules के माध्यम से public/private streets के Subsoil में underground utilities के Rights of Way को regulate कर सकती है।
Underground Utilities के Examples: electricity supply, telephone, telecommunications, gas pipes, water supply, drainage, sewerage, underground rail system, pedestrian subways, shopping plazas, warehousing facilities आदि हैं।
Municipality की भूमिका: Rules में Municipality द्वारा Specific Right of Way की sanction का framework बनाया जा सकता है।
Utility Agency से Maps: Utility provider को Municipality को maps, drawings, statements देने पड़ सकते हैं ताकि Municipality Precise Underground Utility Records maintain कर सके।
Time Limit: Underground utility work के लिए Time limit prescribe की जा सकती है। Delay पर Penalty लगाई जा सकती है।
Damaged Street की Restoration: यदि underground utility work के दौरान municipal street/property damage हो जाए तो Concerned Department/Body को अपने खर्चे पर original condition में restore करना होगा।
5. SECTION 185 — Underground Utility Maps
Chief Municipal Officer (CMO) को ensure करना है कि Municipality में survey maps, drawings, descriptions of all underground utilities maintain हों। साथ ही fire hydrants, sewerage manholes के maps भी maintain होंगे।
Confidentiality: इन maps/records की secrecy Right to Information law के provisions के अनुरूप maintain करनी है।
Exam Trap: “CMO underground utility maps maintain नहीं करता।” ❌ CMO = Responsible
6. SECTION 186 — Government Roads
यदि National Highway, State Highway या कोई street Central या State Government में vested है, तो Municipality की power unrestricted नहीं है।
Central/State Sanction: ऐसी Government street पर ऐसा act करने की permission देने से पहले Central Government या State Government की sanction आवश्यक हो सकती है, depending on vesting.
State Government Road — Municipality का Control: State Government में vested road जो municipal area से गुजरती है, उस पर Municipality Temporary occupation और Encroachment removal के मामलों में control रखती है। लेकिन Road Maintenance = State Government के पास रहती है।
बहुत महत्वपूर्ण: Control ≠ Maintenance
7. SECTION 187 — Festivals
Chief Municipal Officer Written Permission दे सकता है: booth, pandal, temporary structure के लिए। Purpose: ceremony/festival और यह public place पर temporary erection हो सकता है।
Fee & Conditions: Permission prescribed fee, prescribed conditions, specified period के अधीन होगी।
Police Consultation — सबसे महत्वपूर्ण point: Permission देने से पहले Traffic Police Officer-in-Charge से consultation आवश्यक है।
Exam Trap: Festival permission के लिए Police की prior consultation है।
Ground Restoration: Festival structure हटने के बाद जिस व्यक्ति को permission मिली थी उसे Ground भरना और original condition में restore करना होगा।
8. SECTION 188 — Construction/Repair Precautions
जब public street, municipal drain या Municipality की property में construction/repair हो रहा हो, CMO को Public Safety सुनिश्चित करनी है।
CMO की प्रमुख Powers:
1. Fence & Guard करा सकता है।
2. Accident Prevention के लिए precautions ले सकता है।
3. Building Material का public street पर deposit रोक सकता है।
4. Scaffolding या temporary erection रोक सकता है।
5. Street Close पूरी/आंशिक रूप से कर सकता है।
6. Traffic Diversion कर सकता है।
7. Street Restoration ensure करेगा।
8. Dangerous Place की repair/enclosure करा सकता है।
Cost Recovery: Dangerous place की repair/enclosure में Municipality का खर्च Owner/Occupier से recover किया जा सकता है।
9. SECTION 189 — Street पर Material
बिना Municipality की Written Permission के कोई व्यक्ति public street पर timber, stone, brick, earth, other building material deposit नहीं कर सकता। Street में hole करना भी prohibited है।
Permission मिलने पर भी: जिसे permission मिली है उसे material/hole को fence करना; enclosure करना; hole secure करना; रात में पर्याप्त lighting देना होगा।
Section 189 Penalty: Contravention पर Fine ₹1,000–₹2,000 और continuing offence: ₹50–₹100 प्रति दिन/रात तक additional fine।
10. SECTION 190 — Footpaths
Municipality को reasonable time के भीतर, resources available होने पर, prescribed width वाली public streets के साथ Raised Footpaths ensure करने हैं।
Minimum Footpath Width: Buildings Permission and Works Committee को minimum width prescribe करनी है: कम-से-कम 1.5 metres प्रत्येक side।
Exam Formula: Footpath = 1.5 m each side minimum
Different Widths: Different categories of public streets और adjoining land use के अनुसार अलग minimum widths prescribe की जा सकती हैं। लेकिन 1.5 m से कम नहीं।
Footpath Width Revision: Minimum widths को Buildings Permission and Works Committee revise कर सकती है।
11. SECTION 191 — Corner Buildings
दो streets के corner पर building बनाते समय Municipality corner को rounded off या played off करने की requirement लगा सकती है। Public convenience/amenity के लिए corner land acquire भी कर सकती है।
Corner Land Acquisition: यदि Municipality corner land acquire करती है तो Compensation payable होगा। Compensation determine करते समय Street improvement से building को होने वाला benefit भी consider होगा।
12. SECTION 192 — Setting Back
यदि building का कोई हिस्सा Regular Line of Public Street से बाहर project करता है, Municipality उसे हटाने/setback करने का direction दे सकती है।
Verandah/Step आदि: यदि projecting portion verandah, step, external structure है तो Municipality किसी भी समय removal/setback की मांग कर सकती है।
Main Building का Projection: यदि projecting portion main building का हिस्सा है, तो action greater portion/material portion के demolished, burnt, fallen होने के समय लिया जा सकता है।
Setback के बाद Land: Setback/removal से public street में जो land add होगी वह Public Street का हिस्सा मानी जाएगी और Municipality में vest होगी।
Open Land within Regular Line: यदि regular line के भीतर open/enclosed private land है और उस पर कोई substantial building नहीं है, Municipality कम-से-कम 15 clear days notice देकर उसे acquire/take possession कर सकती है।
State Government Land: यदि ऐसी land State Government में vested है, तो Municipality को संबंधित authorised State officer की Written Permission चाहिए।
Compensation: Section 192 के तहत acquired land तथा consequential loss/damage के लिए Compensation देय है। लेकिन Section 243 के dangerous building cases में statutory exception है।
13. SECTION 193 — Level of Buildings
कोई building इतनी lower level पर नहीं बनाई जा सकती कि Proper drainage possible न हो। Building drainage public sewer, public drain, projected municipal drain, stream, approved cesspool, other suitable approved place में जा सके।
14. SECTION 194 — Building Permission
यह Chapter का सबसे महत्वपूर्ण Section है। किसी Municipality area में construction से पहले prescribed application आवश्यक है।
किन Works के लिए Application?
1. New Building बनाना चाहता है।
2. Re-erection करना चाहता है।
3. Material Addition करना चाहता है।
4. Projecting Portion बनाना/re-erect करना चाहता है।
5. Well/Boring बनाना या enlarge करना चाहता है।
6. Tower/Similar Structure erect/re-erect करना चाहता है।
“Material Addition” का अर्थ: Material addition में changes शामिल हैं: setbacks, coverage, height, land use, mandatory parking areas में।
Application के साथ Documents: मुख्यतः: Title Documents, Affidavit, Prescribed Fee Receipt, Six Copies of Map, Site Plan, Other required documents देने होते हैं।
Map में क्या दिखाना है? Map में construction specifications, building height, permissible covered area, open spaces, setbacks, parking, ventilation आदि दिखाए जाते हैं।
Map कौन Authenticate करेगा? Map Qualified Architect/Engineer द्वारा signed और authenticated होना चाहिए, जो संबंधित competent authority द्वारा registered/approved हो।
Title Scrutiny की सीमा: Municipality की title scrutiny का उद्देश्य मुख्यतः यह देखना है कि land/building Government या Public Agency का तो नहीं है और applicant के पास Legal Possession हो।
Building Plan Sanction ≠ Title: यह बहुत महत्वपूर्ण legal point है: Municipality द्वारा building plan sanction Applicant के favour में title create नहीं करता।
Exam Trap: “Building permission मिलते ही ownership establish हो जाती है।” ❌
Electronic Submission: Municipality bye-laws के माध्यम से documents Electronic Form में submit करने की अनुमति दे सकती है।
Decision Period: Complete application मिलने के बाद Municipality को 2 months के भीतर written decision communicate करना है।
Municipality के Options: Authority approve, reject, modify map, impose conditions, impose restrictions कर सकती है।
Deemed Permission: यदि Municipality 2 months में decision communicate नहीं करती, applicant 1 month clear notice देने के बाद Deemed Permission मानकर construction शुरू कर सकता है। लेकिन Act + Rules + Bye-Laws का पालन करना mandatory है।
Deemed Permission — Golden Rule: Silence ≠ Unrestricted Permission. Deemed permission का मतलब यह नहीं कि applicant Building Bye-Laws violate कर सकता है। Applicant और architect/engineer की compliance responsibility बनी रहती है।
Special Small Residential Exemption — Section 194(7)(d): यदि application submitted है; area 250 sq. metres से कम है; individual single residential unit है; construction first floor तक है; total height 10 metres से अधिक नहीं है; तो written permission की आवश्यकता नहीं हो सकती। लेकिन यह exemption certain walled city areas जहाँ separate bye-laws हैं; heritage areas में लागू नहीं होती।
सबसे बड़ा Numerical Trap: 250 sq. m और 10 m को याद रखें। यह हर building के लिए exemption नहीं है। यह specified Individual Single Residential Unit के लिए है।
Multi-Storey Building: Section 194 में 15 metres से अधिक height का building Multi-storeyed building के रूप में specifically treated है।
Regional Town Planner Advice: यदि application 15 m building, institutional complex, 500 sq. m commercial complex से संबंधित है, Municipality को permission देने से पहले Regional Town Planner of State Government की advice लेनी होगी।
Town Planner Advice — Other Buildings: Non-residential building, multi-storeyed building, complex या basement construction के लिए Area Town Planner की advice लेने का statutory framework है।
No Construction Before Permission: General rule: Written Permission के बिना construction शुरू नहीं। लेकिन Section 194(7)(d) वाला specific small-residential exception अलग है।
CMO Inspection Power: CMO/authorised officer Site inspection और Measurement कर सकता है। Purpose: application decide करना; sanctioned plan compliance check करना।
Unauthorized Construction पर CMO: CMO notice दे सकता है; stop construction कर सकता है; violating construction remove/dismantle कराने को कह सकता है; premises का use prohibit कर सकता है।
Change of Land Use: यदि building permission application में Change of Present Land Use involved है और Section 182 के तहत separate permission चाहिए, Municipality उस CLU application को स्वयं decide नहीं करेगी। इसे State Government / Concerned Authority को refer करेगी।
Occupancy Certificate: >15 metre height के building में completion के बाद और occupancy से पहले Occupancy Certificate आवश्यक है। Occupancy Certificate कौन? Chief Municipal Officer necessary inspection के बाद certificate issue करता है या defects rectify करने को कह सकता है।
Occupancy Without Certificate: 15m building को Occupancy Certificate के बिना occupy या allow to occupy नहीं किया जा सकता। Occupancy Violation Penalty: Conviction पर Fine ₹30,000 से ₹50,000 और continuing contravention: ₹500/day तक।
Section 194 — Unauthorized Construction Penalty: यदि application submit किए बिना construction किया: Simple Imprisonment 1 month से 3 months या Fine ₹20,000 से ₹50,000 या दोनों।
Sanctioned Plan Violation: यदि construction sanctioned plan के विरुद्ध है: Imprisonment 15–45 days या Fine ₹10,000–₹20,000 या दोनों।
Architect/Engineer की Liability: यदि architect/engineer द्वारा authenticated map Act/Rules/Bye-Laws के inconsistent पाया जाता है: blacklisting, registration cancellation हो सकता है। और conviction पर Imprisonment 1–2 months या Fine ₹5,000–₹10,000 या दोनों।
Fake Documents: यदि permission लेने के लिए fabricated documents, fake documents, false statements, material facts concealment किए गए हों: Criminal prosecution हो सकता है। CMO को criminal proceedings initiate करने की responsibility है।
Municipality Officer की Liability: यदि responsible officer application disposal की statutory period को wilfully ignore करता है, तो उसके विरुद्ध punishment का statutory provision है।
Municipality की Demolition Power: Unauthorized/permission-violating construction के मामले में Municipality Whole या Part Demolition कर सकती है, statutory conditions के अनुसार।
Dry Latrine: Municipality Dry Latrine का construction permit नहीं करेगी। यदि कोई व्यक्ति dry latrine construct/maintain करता है: Municipality को demolition action लेना है।
Appeal Against Building Order: Aggrieved person 30 days के भीतर State Government या State Government द्वारा authorised officer को appeal कर सकता है।
CURRENT BUILDING BYE-LAWS — 2026 POSITION: पुराने notes में केवल 2010/2013 building bye-laws पढ़ना पर्याप्त नहीं है। Rajasthan Urban Development & Housing Department की current official website पर Rajasthan Building Bye Laws – 2025 अलग से listed हैं। साथ ही Rajasthan Building Bye Laws – 2020, Mount Abu Building Bye Laws – 2019, Jaisalmer Building Bye Laws – 2015, Unified Building Bye Laws – 2017 भी repository में उपलब्ध हैं। इसलिए EO/RO preparation में Section 194 = Act का statutory framework और Rajasthan Building Bye Laws 2025 = वर्तमान technical/procedural framework दोनों को अलग-अलग पढ़ना चाहिए।
15. SECTION 195 — Apartment Complex
Builder/developer + unit owners की responsibility है कि complex occupancy के लिए ready होने पर Residents' Association set up करें।
Builder की मुख्य Responsibilities:
1. Common Facilities disclose करनी हैं।
2. Parking details disclose करने हैं।
3. Corpus Fund बनाकर Residents' Association को hand over करना है।
4. Security/Common Facilities association को hand over करनी हैं।
5. Important Documents hand over करने हैं।
Documents to Residents' Association: मुख्य documents: approved building plan, permission letter, lift warranty, water supply equipment warranty, generator warranty, other important equipment warranties, land-owner agreement, if any, sewerage design, water-supply design आदि।
Completion Certificate रोकने की Power: यदि Section 195 की required formalities पूरी नहीं हुईं: Municipality Completion Certificate issue नहीं करेगी।
16. SECTION 196 — Display Board
Construction शुरू करने से पहले building site पर Display Board लगाना होगा। Board सामान्यतः 4 × 4 feet का होगा, जब तक Municipality अलग specification न दे।
Display Board में क्या-क्या?
1. Builder/person/agency का name, address, phone.
2. Building site details + owner details.
3. Permission number/date.
4. Proposed use.
5. Number of floors.
6. Number of units.
7. Construction area.
8. Public parking units.
9. Starting date.
10. Finishing date.
11. यदि permission required नहीं है तो उसका reason.
Display Board Penalty: Contravention: Fine up to ₹50,000।
17. SECTION 197 — Hoardings
यदि construction/demolition/repair का काम street में obstruction या danger/inconvenience पैदा कर सकता है, तो work शुरू करने से पहले Written Licence Municipality से लेना होगा।
Hoarding/Fencing: Person को Sufficient hoarding/fence लगाना होगा। उसे maintained रखना; public safety के लिए sufficient रखना; रात में adequately light करना; Municipality के direction पर हटाना होगा।
Section 197 Penalty: पहली conviction: ₹1,000–₹2,000 और continuing: ₹50–₹100 प्रति day/night additional fine।
18. SECTION 198 — Amenities Takeover
Municipality किसी private authority/agency/person द्वारा developed colony/scheme की amenities की maintenance responsibility Automatically नहीं लेती। पहले statutory conditions पूरी करनी होंगी।
दो मुख्य Conditions: Municipality तभी responsibility लेगी जब: 1. Relevant records: plans, specifications, designs submit हों। 2. Municipality satisfied हो कि amenities Applicable laws के अनुसार constructed/developed हैं।
Deficiency मिलने पर: यदि construction/operation में deficiency मिले: Municipality developer से Option 1: Deficiency improve करने को कह सकती है। या Option 2: Deficiency Charges pay करने को कह सकती है।
Amenities में क्या-क्या? Section 198 में: roads, bridges, communication, transport, streets, open spaces, parks, recreational grounds, playgrounds, water supply, gas supply, electricity, energy sources, street lighting, sewerage, drainage, conservancy, public works आदि शामिल हैं।
19. SECTION 199 — Colony Takeover
Other agency द्वारा developed colony/scheme को Municipality तभी takeover करेगी जब Plans पहले approve हुए हों या Colony existing laws/rules के अनुसार हो।
Takeover से पहले Municipality को क्या verify करना है?
1. Prescribed amenities provided हैं।
2. या deficiency charges paid हैं।
3. Proof of title submitted है।
4. Plans submitted हैं।
5. Specifications submitted हैं।
6. Designs submitted हैं।
Takeover के बाद: Takeover के बाद Scheme, Colony, Amenities Municipality में Vest हो जाते हैं। Municipality को scheme के अनुसार properties के disposal के rights भी मिलते हैं।

3. SECTION 183 — Regular Line of Public Street
Regular Line — regular street boundary line
Every Municipality shall prescribe a line on one or both sides of a public street. Its main purpose may be to widen the Public Street.
Fresh Regular Line: Municipality may, when necessary, replace Existing line and prescribe Fresh Line. But this process cannot be done without notice.
One-Month Notice: At least 1 month before prescribing new regular line, Municipality shall give Special Notice. Notice shall be affixed in street/affected part; and given to owners/occupiers of affected land.
Exam Fact: Regular Line → 1 Month Previous Notice
Objections & Suggestions: Written objections and suggestions given by affected persons shall be considered by Municipality.
Regular Line Map: Municipality shall prepare a Map showing prescribed line, concerned street, enclosed lands. This map and land statement shall be available for Public Inspection.
Legal Effect of Regular Line: Prescribed line is called Regular Line of Public Street. Thereafter, no person shall construct or reconstruct building within this line.
Section 183 — Penalty: If any person constructs/reconstructs within regular line: Fine ₹2,000 to ₹5,000 and Municipality may stop construction; may cause construction/demolition by written notice.
Appeal: Person aggrieved by Section 183(4) order may appeal to Collector within 30 days. Collector's appellate order is Final and cannot be challenged in Court.
4. SECTION 184 — Underground Utilities
State Government may through rules regulate Rights of Way in Subsoil of public/private streets for underground utilities.
Examples of Underground Utilities: electricity supply, telephone, telecommunications, gas pipes, water supply, drainage, sewerage, underground rail system, pedestrian subways, shopping plazas, warehousing facilities, etc.
Role of Municipality: Rules may provide a framework for sanction of Specific Right of Way by Municipality.
Maps from Utility Agency: Utility provider may have to give maps, drawings, statements to Municipality so that Municipality can maintain Precise Underground Utility Records.
Time Limit: Time limit may be prescribed for underground utility work. Penalty may be imposed for delay.
Restoration of Damaged Street: If municipal street/property is damaged during underground utility work, Concerned Department/Body shall restore to original condition at their own expense.
5. SECTION 185 — Underground Utility Maps
Chief Municipal Officer (CMO) shall ensure that survey maps, drawings, descriptions of all underground utilities are maintained in Municipality. Maps of fire hydrants, sewerage manholes shall also be maintained.
Confidentiality: Secrecy of these maps/records shall be maintained in accordance with Right to Information law provisions.
Exam Trap: “CMO does not maintain underground utility maps.” ❌ CMO = Responsible
6. SECTION 186 — Government Roads
If National Highway, State Highway or any street is vested in Central or State Government, Municipality's power is not unrestricted.
Central/State Sanction: Before granting permission for any act on such Government street, sanction of Central Government or State Government may be necessary, depending on vesting.
State Government Road — Municipality's Control: On roads vested in State Government passing through municipal area, Municipality has control in matters of Temporary occupation and Encroachment removal. But Road Maintenance = remains with State Government.
Very important: Control ≠ Maintenance
7. SECTION 187 — Festivals
Chief Municipal Officer may give Written Permission for booth, pandal, temporary structure. Purpose: ceremony/festival and it may be temporary erection on public place.
Fee & Conditions: Permission shall be subject to prescribed fee, prescribed conditions, specified period.
Police Consultation — most important point: Before granting permission, consultation with Traffic Police Officer-in-Charge is necessary.
Exam Trap: Festival permission requires prior consultation with Police.
Ground Restoration: After festival structure is removed, the person to whom permission was granted shall fill the Ground and restore to original condition.
8. SECTION 188 — Construction/Repair Precautions
When construction/repair is being carried out on public street, municipal drain or Municipality's property, CMO shall ensure Public Safety.
CMO's main Powers:
1. May cause Fence & Guard.
2. May take precautions for Accident Prevention.
3. May stop deposit of Building Material on public street.
4. May stop Scaffolding or temporary erection.
5. May close Street wholly/partially.
6. May cause Traffic Diversion.
7. Shall ensure Street Restoration.
8. May cause repair/enclosure of Dangerous Place.
Cost Recovery: Municipality's expense on repair/enclosure of dangerous place may be recovered from Owner/Occupier.
9. SECTION 189 — Material on Street
Without Municipality's Written Permission, no person shall deposit timber, stone, brick, earth, other building material on public street. Making hole in street is also prohibited without permission.
Even with Permission: The person who has permission shall fence the material/hole; enclose; secure the hole; provide adequate lighting at night.
Section 189 Penalty: On contravention: Fine ₹1,000–₹2,000 and continuing offence: additional fine ₹50–₹100 per day/night.
10. SECTION 190 — Footpaths
Municipality shall, within reasonable time and subject to availability of resources, ensure Raised Footpaths along prescribed width public streets.
Minimum Footpath Width: Buildings Permission and Works Committee shall prescribe minimum width: at least 1.5 metres on each side.
Exam Formula: Footpath = 1.5 m each side minimum
Different Widths: Different minimum widths may be prescribed for different categories of public streets and adjoining land use. But not less than 1.5 m.
Footpath Width Revision: Buildings Permission and Works Committee may revise minimum widths.
11. SECTION 191 — Corner Buildings
While constructing building at corner of two streets, Municipality may require the corner to be rounded off or played off. It may also acquire corner land for public convenience/amenity.
Corner Land Acquisition: If Municipality acquires corner land, Compensation shall be payable. While determining compensation, benefit to building from street improvement shall also be considered.
12. SECTION 192 — Setting Back
If any part of building projects beyond Regular Line of Public Street, Municipality may direct its removal/setback.
Verandah/Step etc.: If projecting portion is verandah, step, external structure, Municipality may demand removal/setback at any time.
Projection of Main Building: If projecting portion is part of main building, action may be taken at time when greater portion/material portion is demolished, burnt, or fallen.
Land after Setback: Land added to public street due to setback/removal shall be deemed part of Public Street and shall vest in Municipality.
Open Land within Regular Line: If within regular line there is open/enclosed private land without any substantial building, Municipality may, after giving at least 15 clear days notice, acquire/take possession.
State Government Land: If such land is vested in State Government, Municipality requires Written Permission of the concerned authorised State officer.
Compensation: Compensation is payable for land acquired under Section 192 and consequential loss/damage. But there is statutory exception in Section 243 dangerous building cases.
13. SECTION 193 — Level of Buildings
No building shall be constructed at such lower level that Proper drainage is not possible. Building drainage may go to public sewer, public drain, projected municipal drain, stream, approved cesspool, other suitable approved place.
14. SECTION 194 — Building Permission
This is the most important Section of this Chapter. In any Municipality area, prescribed application is required before construction.
For which Works is Application required?
1. To construct New Building.
2. To re-erect.
3. To make Material Addition.
4. To construct/re-erect Projecting Portion.
5. To construct or enlarge Well/Boring.
6. To erect/re-erect Tower/Similar Structure.
Meaning of “Material Addition”: Material addition includes changes in setbacks, coverage, height, land use, mandatory parking areas.
Documents with Application: Mainly: Title Documents, Affidavit, Prescribed Fee Receipt, Six Copies of Map, Site Plan, Other required documents.
What to show in Map? Map shall show construction specifications, building height, permissible covered area, open spaces, setbacks, parking, ventilation, etc.
Who will authenticate Map? Map shall be signed and authenticated by Qualified Architect/Engineer registered/approved by the concerned competent authority.
Limit of Title Scrutiny: Municipality's title scrutiny is mainly to see that land/building does not belong to Government or Public Agency and applicant has Legal Possession.
Building Plan Sanction ≠ Title: This is a very important legal point: Municipality's building plan sanction does not create title in favour of applicant.
Exam Trap: “Building permission establishes ownership.” ❌
Electronic Submission: Municipality may through bye-laws allow submission of documents in Electronic Form.
Decision Period: Within 2 months of receipt of complete application, Municipality shall communicate written decision.
Municipality's Options: Authority may approve, reject, modify map, impose conditions, impose restrictions.
Deemed Permission: If Municipality does not communicate decision within 2 months, applicant may, after 1 month clear notice, start construction considering Deemed Permission. But compliance with Act + Rules + Bye-Laws is mandatory.
Deemed Permission — Golden Rule: Silence ≠ Unrestricted Permission. Deemed permission does not mean applicant can violate Building Bye-Laws. Applicant and architect/engineer remain responsible for compliance.
Special Small Residential Exemption — Section 194(7)(d): If application is submitted; area is less than 250 sq. metres; individual single residential unit; construction up to first floor; total height not more than 10 metres; then written permission may not be required. But this exemption does not apply in certain walled city areas where separate bye-laws apply; heritage areas.
Biggest Numerical Trap: Remember 250 sq. m and 10 m. This is not an exemption for every building. It is for specified Individual Single Residential Unit.
Multi-Storey Building: Under Section 194, building with height above 15 metres is specifically treated as Multi-storeyed building.
Regional Town Planner Advice: If application relates to 15 m building, institutional complex, 500 sq. m commercial complex, Municipality shall take advice of Regional Town Planner of State Government before granting permission.
Town Planner Advice — Other Buildings: For non-residential building, multi-storeyed building, complex or basement construction, there is a statutory framework for advice of Area Town Planner.
No Construction Before Permission: General rule: No construction without Written Permission. But Section 194(7)(d) specific small-residential exception is separate.
CMO Inspection Power: CMO/authorised officer may conduct Site inspection and Measurement. Purpose: to decide application; to check compliance with sanctioned plan.
CMO on Unauthorized Construction: CMO may give notice; stop construction; require removal/dismantling of violating construction; prohibit use of premises.
Change of Land Use: If building permission application involves Change of Present Land Use and separate permission under Section 182 is required, Municipality shall not decide that CLU application itself. It shall refer it to State Government / Concerned Authority.
Occupancy Certificate: For building >15 metre height, Occupancy Certificate is required after completion and before occupancy. Who issues Occupancy Certificate? Chief Municipal Officer after necessary inspection may issue certificate or require rectification of defects.
Occupancy Without Certificate: 15m building shall not be occupied or allowed to be occupied without Occupancy Certificate. Occupancy Violation Penalty: On conviction Fine ₹30,000 to ₹50,000 and continuing contravention: up to ₹500/day.
Section 194 — Unauthorized Construction Penalty: If construction is done without submitting application: Simple Imprisonment 1 month to 3 months or Fine ₹20,000 to ₹50,000 or both.
Sanctioned Plan Violation: If construction is contrary to sanctioned plan: Imprisonment 15–45 days or Fine ₹10,000–₹20,000 or both.
Architect/Engineer Liability: If map authenticated by architect/engineer is found inconsistent with Act/Rules/Bye-Laws: blacklisting, registration cancellation may happen. And on conviction: Imprisonment 1–2 months or Fine ₹5,000–₹10,000 or both.
Fake Documents: If fabricated documents, fake documents, false statements, concealment of material facts are used to obtain permission: Criminal prosecution may be initiated. CMO has responsibility to initiate criminal proceedings.
Municipality Officer Liability: If responsible officer wilfully ignores statutory period for disposal of application, there is statutory provision for punishment against him.
Municipality's Demolition Power: In case of unauthorized/permission-violating construction, Municipality may demolish Whole or Part, as per statutory conditions.
Dry Latrine: Municipality shall not permit construction of Dry Latrine. If any person constructs/maintains dry latrine, Municipality shall take demolition action.
Appeal Against Building Order: Aggrieved person may appeal to State Government or officer authorised by State Government within 30 days.
CURRENT BUILDING BYE-LAWS — 2026 POSITION: Reading only 2010/2013 building bye-laws in old notes is not sufficient. Rajasthan Urban Development & Housing Department's current official website separately lists Rajasthan Building Bye Laws – 2025. Also Rajasthan Building Bye Laws – 2020, Mount Abu Building Bye Laws – 2019, Jaisalmer Building Bye Laws – 2015, Unified Building Bye Laws – 2017 are available in repository. Therefore in EO/RO preparation, Section 194 = statutory framework of the Act and Rajasthan Building Bye Laws 2025 = current technical/procedural framework should be read separately.
15. SECTION 195 — Apartment Complex
Builder/developer + unit owners have responsibility to set up Residents' Association when complex is ready for occupancy.
Builder's main Responsibilities:
1. Disclose Common Facilities.
2. Disclose Parking details.
3. Create Corpus Fund and hand over to Residents' Association.
4. Hand over Security/Common Facilities to association.
5. Hand over Important Documents.
Documents to Residents' Association: Main documents: approved building plan, permission letter, lift warranty, water supply equipment warranty, generator warranty, other important equipment warranties, land-owner agreement, if any, sewerage design, water-supply design, etc.
Power to stop Completion Certificate: If required formalities of Section 195 are not completed, Municipality shall not issue Completion Certificate.
16. SECTION 196 — Display Board
Before starting construction, a Display Board shall be put up at the building site. The Board shall generally be 4 × 4 feet, unless Municipality specifies otherwise.
What should be on Display Board?
1. Name, address, phone of Builder/person/agency.
2. Building site details + owner details.
3. Permission number/date.
4. Proposed use.
5. Number of floors.
6. Number of units.
7. Construction area.
8. Public parking units.
9. Starting date.
10. Finishing date.
11. If permission is not required, reason for that.
Display Board Penalty: Contravention: Fine up to ₹50,000.
17. SECTION 197 — Hoardings
If construction/demolition/repair work may cause obstruction or danger/inconvenience on street, Written Licence from Municipality is required before starting work.
Hoarding/Fencing: Person shall put up Sufficient hoarding/fence. He shall maintain it; keep it sufficient for public safety; adequately light it at night; remove it as per Municipality's direction.
Section 197 Penalty: On first conviction: ₹1,000–₹2,000 and continuing: additional fine ₹50–₹100 per day/night.
18. SECTION 198 — Amenities Takeover
Municipality does not Automatically take over maintenance responsibility of amenities of colony/scheme developed by private authority/agency/person. Statutory conditions must be fulfilled first.
Two main Conditions: Municipality shall take responsibility only when: 1. Relevant records: plans, specifications, designs are submitted. 2. Municipality is satisfied that amenities are constructed/developed as per Applicable laws.
If Deficiency is found: If there is deficiency in construction/operation, Municipality may require developer: Option 1: Improve Deficiency. Or Option 2: Pay Deficiency Charges.
What are Amenities? Section 198 includes: roads, bridges, communication, transport, streets, open spaces, parks, recreational grounds, playgrounds, water supply, gas supply, electricity, energy sources, street lighting, sewerage, drainage, conservancy, public works, etc.
19. SECTION 199 — Colony Takeover
Municipality shall take over colony/scheme developed by other agency only if Plans were previously approved or Colony is as per existing laws/rules.
What should Municipality verify before Takeover?
1. Prescribed amenities are provided.
2. Or deficiency charges are paid.
3. Proof of title is submitted.
4. Plans are submitted.
5. Specifications are submitted.
6. Designs are submitted.
After Takeover: After takeover, Scheme, Colony, Amenities Vest in Municipality. Municipality also gets rights of disposal of properties as per scheme.
